CONTEST RULES

 

The “Collette’s Costa Rica: A World of Nature Contest” (the “Contest”) is organized by Pelmorex Corp. (the "Contest Organizer") (doing business as The Weather Network and Meteo Media) and Collette Tours Canada Ltd. (“Travel Administrator” or “Collette”). The Contest Organizer is responsible for the Contest, its organization and the Contest Rules (the "Rules"), as well as selecting and notifying the winner. Travel Administrator is responsible for prizing and fulfillment of prizing.

 

The Contest will run from Monday September 30, 2024 Eastern Standard Time (EST) until Sunday October 27, 2024 11:59 p.m. (EST) (the "Contest Period").

 

By registering and participating in the Contest, Entrants get a chance to win a guided group tour for two people to Costa Rica (hereinafter “Prize”). By entering the Contest, Entrants agree to be bound by these Rules.

 

1. ELIGIBILITY. The Contest is open to all legal residents of Canada who have reached the age of majority in their province or territory of residence as of the date of entry. Each Entrant  (referred to as an "Entrant", together, the "Entrants") must have  a valid email address and Internet access prior to the start of the Contest Period. Employees, agents, representatives, officers and directors of the Contest Organizer and Travel Administrator, its subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, sponsors, suppliers of Prizes, materials and services related to this Contest, or of any other party directly associated with the holding of the Contest, as well as members of their immediate families (brothers, sisters, children, father, mother), their legal or common-law spouse, and any persons residing with these employees, agents, representatives, officers and directors are not eligible to participate.

 

2. HOW TO PARTICIPATE. NO PURCHASE NECESSARY. To enter online: visit http://www.theweathernetwork.com/explore/collette , complete the official online entry form providing Entrant’s valid email address, full name, home address and phone number and click ‘ENTER’ where indicated. 

There is a limit of one entry per person/email address. If two or more otherwise eligible individuals share a single email address, only one of them may enter the Contest; and, if an eligible individual has multiple email addresses, they may only enter the Contest once in respect of only one of those email addresses. In the case of multiple entries, only the first eligible entry will be considered. 

Entries must be received no later than 11:59 pm EST on October 27, 2024. Travel Administrator and Contest Organizer are not responsible for entries that become lost or misdirected. 

 

3. PRIZES.

One Collette guided tour Prize available to be won

consisting of: 

  • Round-trip economy air for the winner and one guest of choice from the international airport within Canada closest to the winner’s residence to Costa Rica on travel dates to be determined by the Travel Administrator.

  • One hotel room (standard room, based on double occupancy) for the duration of the trip in or around the Destination at a hotel to be selected by the Travel Administrator.

  • Costa Rica: A World of Nature tour

 

The following terms and conditions apply to any Prize awarded in this Contest:

  1. The winner may be required to reserve the  Prize, or complete travel, by December 31, 2025, as advised by the Travel Administrator. Departure dates chosen are subject to tour availability. The Prize is not eligible for frequent flyer miles. All bookings and/or reservations are subject to availability at the time of booking. Once reservations are made, they cannot be changed, unless otherwise determined by the Travel Administrator. 

  2. Each traveller must have reached the age of majority in his or her province or territory of residence, unless accompanied by a parent or legal guardian. 

  3. Travellers may be required to present a valid major credit card upon check-in at the hotel(s) to cover any expenses above and beyond the standard room charge.  

  4. If the winner elects to travel with a fewer number of guests than the number of guests provided in the Prize description above, no additional compensation will be awarded under any circumstances.

  5. Tickets are subject to certain terms and conditions as specified by issuers. Blackout dates may apply (as advised by the Travel Administrator). 

  6. Travellers are responsible for: transportation to and from originating airport; travel and medical insurance; travel documentation including but not limited to valid passports and any required visas (as applicable); any and all applicable taxes; and any additional expenses not included in the Prize

  7. Contest Organizer and Collette are not responsible for any cancellations, alterations, delays, diversions or other changes to the trip itinerary, any costs or expenses incurred as a result of any changes to the trip itinerary, or any damages, loss or liability in the event any traveller is denied the ability to travel for any reason. 

  8. Collette has the right to disqualify or remove any traveller from any activity at any time if they are at any point uncooperative, disruptive, abusive, unobservant of applicable rules, laws or regulations, or likely to cause or has caused damage to person, property, or the reputation of the Travel Administrator.

 

All Prize particulars will be determined by the Travel Administrator in its sole discretion. Any Prize awarded in the Contest is subject to the following conditions:

  1. Except for gift cards, vouchers or cash prizes, the Prize value in these Official Rules is approximate only. You will not be compensated if actual Prize value is lower than the value quoted in these Official Rules;

  2. The Travel Administrator reserves the right, in their sole discretion, to substitute a Prize, in whole or in part, with a prize or prize component of equal or greater value if the prize or any component thereof cannot be awarded for any reason. 

  3. The Prize must be accepted as awarded and may not be transferred or resold, unless otherwise determined by the Travel Administrator. The Prize may not be exactly as advertised. The Prize is provided “as is” without representation or warranty of any kind by the Travel Administrator; and

  4. Any unused portion of the Prize, once awarded, will be deemed forfeited. A Prize, if awarded in the form of a travel voucher, will not be replaced if lost, destroyed, mutilated or stolen or in the case of any portion of the tour will not be replaced or compensated for if not taken for any reason.

 

To be eligible to enter this Contest, an individual must: 

  1. be legally able to travel to Costa Rica and have any and all necessary documentation as may be required for presentation to Canadian and/or International customs and airport personnel.

  2. If selected as the potential winner (as defined below), be able to participate in the prize on the dates and times set out by the Travel Administrator.

 

4. WINNERS SELECTION and CONFIRMATION. One winner will be randomly selected on or about Monday October 28, 2024 from all eligible entries received. The selected Entrant will be notified by Pelmorex Corp. via email within 3 days of the drawing with details on how to claim their Prize. Before being declared a winner, the selected Entrants must correctly answer, without assistance of any kind, a mathematical skill-testing question to be administered via email. Odds of winning are entirely dependent on the number of entries received. To claim a Prize, winner must sign and return an Affidavit of Eligibility and Liability/Publicity Release (except where prohibited) within 3 business days of notification. If the winner does not comply, the Prize package will be forfeited and an alternate winner may be selected, at Contest Organizer’s and/or Travel Administrator’s sole discretion. Odds of winning will depend on the number of eligible entries received.

 

Acceptance of Prize. By accepting the Prize, winner agrees to the use of his or her name, photo, and/or likeness for purposes of advertising or promotion without further compensation. Prizes must be accepted as described in these Rules and may not, in any case, be in whole or in part transferred to another person, replaced by another Prize or exchanged for cash, except as provided below. 

 

Prize substitution. In the event where it would be impossible, difficult and/or more costly for the Contest Organizer to award a Prize (or part of Prize) as described in these Contest Rules, Contest Organizer reserves the right to award a Prize (or part of Prize) of the same kind and of equivalent value or, at the Contest Organizer’s and Collette’s sole discretion, the cash value of a Prize (or part of Prize) as indicated in these Contest Rules.

 

5. LIMITATION OF LIABILITY – Use of Prize. The winner releases Collette and Contest Organizer, their respective subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, employees, agents, representatives, officers and directors ("Released Parties") from any liability for damage of any kind whatsoever that he or his guests may suffer, directly or indirectly, by reason of acceptance, possession or use of the Prize.

 

For this purpose, winner hereby (i) acknowledges and confirms that Released Parties are not granting any warranties or assurances of any kind pertaining to the Prizes awarded in connection with the Contest; (ii) acknowledges and confirms the absence of any implied warranties and (iii) agrees to sign a declaration and release form before receiving his/her Prize.

 

Any and all costs incurred by a winner to claim, use or redeem his/her Prize shall be borne by the winner.

 

5. GENERAL CONDITIONS

 

Conduct. All Entrants agree to be bound by these Rules. 

 

Decisions of the Contest Organizer. Any decision of the Contest Organizer regarding any aspect of this Contest, including, without being limited to, the eligibility and/or disqualification of Participation Forms, shall be final and without appeal.

 

Disqualification. Any person entering or attempting to enter the Contest by means that are contrary to the Rules or unfair to other Entrants (for example, entries in excess of the prescribed limit, if any) will automatically be disqualified and may be referred to the competent legal authorities.

 

Limitation of Liability. Neither Content Organizer nor Travel Administrator is responsible for late, lost, incomplete, irregular or misdirected entries or for any malfunction of any computer component, software or communication line in connection with the loss or absence of network communication or with any defective, incomplete, incomprehensible or deleted transmission from any computer or network that may limit any person’s opportunity to enter the Contest or prevent him from entering the Contest. Entrants further agree to release the Contest Organizer and Travel Administrator from any liability resulting from, or related to participation in the Contest or the awarding or use of any Prize. 

 

Modification. The Contest Organizer reserves the right, at its sole discretion, subject to compliance with applicable legal and regulatory requirements, to cancel, terminate, modify or suspend all or any part of this Contest at any time. 

 

Number of Prizes Awarded. In all cases, the Contest Organizer and the Travel Administrator, their respective subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, employees, agents, representatives, officers and directors, and their suppliers of products, materials and services related to this Contest, and their respective employees, agents and representatives cannot be required to award more Prizes than the number indicated in the Rules or to award prizes other than in accordance with the Rules.

 

If computer, printing, production, mechanical, seeding, typographical, or other errors result in more valid Prize claims for any prize level than the number stated herein, the Contest Organizer reserves the right to award the stated number of Prizes for the prize level at issue in a random draw from among all eligible, non-suspect, and valid Prize claims received for the applicable prize level.

 

Authorizations. By entering the Contest, Entrants agree to have their submitted name displayed on the Contest Organizer’s and Travel Administrator’s respective websites and applicable social media pages and used by Contest Organizer and Travel Administrator for any purpose regarding the Contest and for promotional and advertising purposes in connection with the Travel Administrator and its products at any time, without any fee or other form of compensation.

 

By entering the Contest, the winner authorizes the Contest Organizer, the Travel Administrator and their respective representatives to use, if required, their names, photo, likeness, statements regarding the Prizes, place of residence and/or voice for advertising purposes in connection with the Contest, without any form of remuneration.

 

Acceptance. By participating in the Contest, Entrants agree to be bound by the Contest Rules and by the decisions of the Contest Organizer, which will be final and won’t be subject to appeal in any respect, including without limitation, any decisions concerning eligibility, disqualification of Participation Forms, or Prize attribution.

 

Governing Law. The Contest is subject to all applicable laws in the province of Ontario and the laws of Canada applicable therein. 

 

Privacy. Entrant’s personal information is collected and used in compliance with Pelmorex’ Contest Privacy Policy, detailed below. 

 

Contests Privacy Policy

Pelmorex Corp. doing business as “The Weather Network” and “MeteoMedia” (collectively “Pelmorex”, “we”, “us”, “our”) is committed to protecting and respecting the privacy of our users and safeguarding the personal information provided to us. This privacy policy applies to our collection and processing of information that you provide to us when you enter one of our contests. 

 

Information Collected

We generally collect the following information in our contest entry forms:

  • Your full name

  • E-mail address

  • Home address

  • Phone number 

This information allows us to contact you should you be the selected winner of the contest. The information is also shared with authorized representatives and our partner(s) solely for the purposes of awarding the prize(s). 

When a contest entry is submitted the information is managed by Wishpond (https://www.wishpond.com/) a third party who assists Pelmorex in running the contest. Your information resides in their system, which is managed by Pelmorex but maintained by Wishpond. Once a winner of the contest has been chosen all entrants’ information is kept on file for three (3) months and then deleted. The winner’s information is kept on file for as long as is required to ensure that the prizing has been fulfilled. 

Access, Correction and Deletion 

You can request access to and deletion of your information upon completion of the contest and within that three month window prior to deletion of the entries.
